Terms and Conditions
Last modified: July 10, 2026
These Terms apply to tours, excursions, experiences, transfers, holiday packages, and related products or services offered by Naru Zanzibar.
Please read these Terms and Conditions (“Terms”) carefully before booking with Naru Zanzibar LLC (“Company,” “Naru Zanzibar,” “we,” “us,” or “our”). In consideration of being permitted to participate in the group tour, group package, private tour, private package, excursion, experience, transfer, or holiday package selected by you (collectively, the “Experience”), you agree to be bound by these Terms.
By making a booking or participating in a Naru Zanzibar Experience, you confirm that you:
- Have read and understand these Terms.
- Expressly accept and agree to be bound by these Terms.
If a booking includes more than one guest or traveller, the person who confirms the booking accepts these Terms on behalf of every person named in the booking, including minors and persons requiring assistance. The lead traveller is the designated contact for everyone included in the booking.
These Terms constitute the entire agreement concerning the subject matter between the traveller and Naru Zanzibar and supersede prior oral or written statements, subject to the booking confirmation, invoice, and any expressly incorporated written terms.
The Booking Contract
A booking is confirmed and these Terms apply when Naru Zanzibar, or an authorized agent acting on its behalf, has received the applicable deposit or full payment and the lead traveller has received written confirmation from Naru Zanzibar.
The lead traveller must be at least 18 years old and must provide full, complete, and accurate information requested to confirm the booking. Where a booking includes other travellers, the lead traveller represents and warrants that:
- The lead traveller has all necessary authority and consent to book for the other travellers and has given them the information needed to authorize the booking.
- Information supplied for all travellers is complete and accurate, and all permissions necessary to share that information have been obtained.
- Every traveller has been informed that these Terms apply to the booking and the relationship with Naru Zanzibar.
Before confirmation, Naru Zanzibar may increase or decrease Website prices or written quotation prices and may decline a booking in its discretion. Prices and quotations may contain conditions, expiry dates, occupancy assumptions, or supplier restrictions.
Confirmation and Itinerary Subject to Modification
After the Company receives the required deposit or full payment, the lead traveller will receive a confirmation email. Please contact us if confirmation is not received within five business days. You consent to receive correspondence relating to the Experience, Company, payments, itinerary, and services.
An itinerary is subject to change. Naru Zanzibar may modify an itinerary because of third-party availability, weather, tides, sea conditions, safety, local conditions, or other circumstances beyond its reasonable control.
Payments
Total Payment
The total payment is due before the Experience start date on the payment due date communicated for your booking. The due date and payment schedule may vary by Experience. If the Company does not receive total payment by the payment due date, it may cancel the reservation, and the deposit and amounts paid may be forfeited. Full payment is non-refundable and non-transferable to a different Experience, getaway, or trip.
Deposit
All deposits and payments are non-refundable. However, where the Company accepts a cancellation for credit or transfer under these Terms, payments may be held as credit or applied to a future qualifying Experience. The deposit remains non-refundable and non-transferable to a different getaway, Experience, or trip.
Before the payment due date, you may request that the deposit be applied to a new participant’s registration for the same Experience. You are responsible for identifying that participant, and acceptance remains subject to Company approval and completion of all required documents.
Payments Made After the Deposit
A cancellation made between 30 and 60 days before departure is subject to a cancellation fee equal to 50% of the total amount paid after the deposit. The remaining 50% may be applied as credit toward a future Experience. A cancellation made 30 days or less before departure is subject to a 100% charge of the total amount paid after the deposit.
Late Payment
Failure to make a payment within ten days after the agreed date is a breach of contract and may result in cancellation, particularly where multiple payments are missed. If you anticipate difficulty making a payment, you must email hello@naruzanzibar.com. A late payment fee of USD 30 may apply. Naru Zanzibar may assign the space to the next eligible traveller on a waitlist. Additional charges caused by late enrollment or a rebooked Experience are the traveller’s responsibility.
Cancellation by the Traveller
A cancellation or amendment must be delivered to Naru Zanzibar in writing and acknowledged by Naru Zanzibar in writing. Except as expressly provided, Naru Zanzibar services are non-refundable and non-transferable between persons. Travellers are strongly advised to purchase insurance covering cancellation.
Trip cancellation insurance may be the only means of receiving reimbursement for flights and other non-refundable expenses when you cancel voluntarily or when travel arrangements are affected by Company action or circumstances beyond the Company’s control.
Amendments and Cancellation
You may request cancellation or amendment up to 60 days before departure. Any difference between the original booking cost and the replacement booking cost remains payable. A cancellation made less than 60 days before departure is subject to the cancellation terms above. Naru Zanzibar does not offer cash refunds for traveller cancellations; where accepted at least 60 days before departure, a qualifying balance may be transferred toward a new Experience or destination.
Private Experiences may be subject to additional fees where accommodation, activities, transport, boats, catering, or other services have already been booked on a non-refundable basis.
Credit Balances
Where a credit is approved, the Company will hold it for six months from the date the original booking is cancelled. An unused credit expires at the end of that period unless the Company agrees otherwise in writing.
Installment Transfer Option
Before the payment due date, you may request that installment payments be applied to another participant’s registration for the same Experience. You are responsible for finding the replacement. The replacement traveller must accept the applicable waiver, cancellation agreement, and Terms and must indemnify Naru Zanzibar from liability arising from the transfer to the extent permitted by law.
Transfer Cancellation Administration Fee
A transfer from one traveller to another may be charged an administration fee equal to the total deposit amount. The replacement traveller must complete the required cancellation agreement, waiver, and booking documentation.
Refunds
You may cancel participation at any time, subject to this policy. The deposit is non-refundable. All payments made toward the booking balance, including full payments, installment payments, and late fees, become non-refundable seven days after payment.
The only exception stated in this policy is where Naru Zanzibar cancels the Experience in its entirety, in which case affected travellers will be notified by email and provided with applicable refund instructions.
Unforeseen situations may arise. Travellers are therefore strongly encouraged to obtain travel insurance. Naru Zanzibar is not responsible for incidental expenses or consequential losses relating to a cancelled booking, including visas, vaccinations, non-refundable flights, rail fares, parking, lost earnings, or loss of enjoyment.
Travellers are strongly encouraged to purchase comprehensive insurance covering available causes of loss under the laws of their country of residence.
Why Payments Are Non-Refundable
Hotels, accommodation providers, guides, transport providers, boat operators, excursion providers, guest speakers, restaurants, and other vendors commonly require advance commitments and non-refundable payments. Naru Zanzibar may make good-faith payments to secure the arrangements offered in a package.
Unused Services
No discount or refund will be provided for a missed or unused service where the service is missed or unused through no fault of Naru Zanzibar or its representatives, including where participation ends because of the traveller’s fault, negligence, failure to attend, or breach of these Terms.
Passport, Visa, Insurance, and Entry Documentation
You are responsible for obtaining and maintaining a valid passport and every visa, permit, certificate, vaccination or health document, airline document, Zanzibar mandatory inbound travel insurance certificate, and other documentation required for entry into, exit from, or travel within Tanzania and Zanzibar, or for participation in a booked Experience (“Documentation”).
Requirements may depend on nationality, residence, age, travel history, route, airline, or government direction. You are responsible for checking current requirements with the relevant government, embassy, consulate, airline, or official authority.
Naru Zanzibar is not responsible if you are denied boarding, entry, exit, transfer, or participation because you do not possess valid and complete Documentation.
Travel Insurance
Travellers subject to Zanzibar’s mandatory inbound travel insurance requirement are responsible for purchasing and maintaining that insurance before travel. Naru Zanzibar does not purchase, arrange, or guarantee the insurance on your behalf and is not responsible for your failure to comply with the requirement.
In addition to mandatory inbound insurance, you are responsible for obtaining comprehensive personal travel insurance appropriate for the full duration and activities of your trip, including swimming, snorkelling, boating, dhow travel, speedboat travel, walking tours, safari drives, beach activities, medical care, evacuation, trip cancellation, curtailment, baggage, personal items, accident, illness, injury, death, property damage, and other potential losses, costs, or liabilities (“Losses”).
You are solely responsible for the cost, adequacy, scope, exclusions, and validity of your insurance. You are responsible for Losses arising from a failure to obtain adequate coverage. Naru Zanzibar and its officers, members, agents, contractors, employees, volunteers, guides, hosts, captains, crew, and representatives are not responsible for Losses you incur or sustain, to the fullest extent permitted by applicable law.
Changes or Cancellations
Experience Changes
Naru Zanzibar may reasonably change departure times, meeting points, routes, vessels, beaches, sandbanks, snorkelling locations, activity order, guides, drivers, hosts, or suppliers because of weather, tides, sea conditions, safety concerns, mechanical issues, road conditions, government instructions, local restrictions, or supplier availability.
Naru Zanzibar cannot guarantee:
- Dolphin or other wildlife sightings.
- The appearance, location, or accessibility of a sandbank.
- Perfectly clear water or a particular sea condition.
- A particular sunset, sunrise, or weather condition.
- Exact tide levels.
- A particular boat or vessel unless expressly confirmed as guaranteed in writing.
You will not be entitled to a refund solely because of reasonable itinerary or service changes described in this section.
Experience Details and Flexibility
An itinerary is a general guide. Reference to a beach, island, sandbank, wildlife area, restaurant, property, route, or other place is not a guarantee that it will be visited or encountered and does not independently form part of the contract unless expressly guaranteed in writing. Itineraries are prepared in good faith and may be improved or changed based on weather, tides, local conditions, safety, traveller feedback, research, or operational experience.
The nature of travel requires flexibility. Routes, schedules, itineraries, amenities, and transport may change without prior notice because of illness, breakdown, flight cancellation, strike, political dispute, entry difficulty, extreme weather, tide, sea condition, local event, or another unpredictable circumstance beyond Naru Zanzibar’s reasonable control.
Cancellation by Naru Zanzibar
Naru Zanzibar may cancel a reservation where total payment is not received by the payment due date, in which case the traveller may be ineligible for a refund, including return of the deposit.
Naru Zanzibar may also cancel an Experience before departure where an insufficient number of travellers is confirmed or for another commercial reason. In that case, Naru Zanzibar will refund the amount remitted to the Company for the cancelled Experience, but will not be responsible for preparation costs, airfare, travel documents, or other Losses or claimed damages.
Written Cancellation
All cancellations by a traveller must be sent in writing to hello@naruzanzibar.com. Where a cancellation takes place before the payment due date, payments may be returned except for the non-refundable deposit, subject to the other payment and cancellation provisions in these Terms. A cancellation after the payment due date may result in forfeiture of the entire amount paid.
Health and Fitness Eligibility, Physical Activity, and Injury
Voluntary Participation
Participation is voluntary and may include physical activity such as swimming, snorkelling, boarding or leaving boats, dhow and speedboat journeys, walking and cultural tours, safari drives, beach and water activities, and exposure to sun, heat, tides, sea conditions, slippery surfaces, and uneven ground (“Physical Activity”).
You acknowledge the risks and hazards associated with travel and Physical Activity, including serious injury, illness, property damage, or death. Every activity is optional. If you elect not to participate, Naru Zanzibar is not responsible for providing an alternative activity or refund.
Health and Fitness
You represent that you are physically and mentally capable of participating in your selected Experience. You must disclose relevant allergies, dietary requirements, pregnancy, mobility limitations, medical conditions, disabilities, or other concerns that may affect participation, safety, or service delivery.
You should consult an appropriate healthcare professional before travel if you have any concern about your ability to participate. Naru Zanzibar may request medical clearance where reasonably necessary. If you doubt your fitness during an activity, you must stop and seek appropriate assistance.
Some Experiences may take place in areas with limited access to medical or hospital facilities. Medical care and evacuation expenses are your responsibility. Naru Zanzibar may refuse or discontinue participation on medical, fitness, safety, behavioral, or operational grounds.
Safety Instructions and Conduct
- You must follow the lawful instructions of captains, crew, guides, hosts, drivers, and Naru Zanzibar representatives.
- Life jackets and other required safety equipment must be used as directed.
- Parents and legal guardians are responsible for supervising children and minors.
- Naru Zanzibar may refuse participation to a person who is intoxicated, abusive, disruptive, or reasonably considered a risk to themselves or others.
Assumption of Risk
Accidents may occur during travel and Physical Activity. You are responsible for familiarizing yourself with relevant travel, cultural, geographic, weather, and safety information and voluntarily assume the ordinary and inherent risks associated with the Experience, including foreseeable and unforeseeable injury, illness, death, and property damage.
Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
Injury, Waiver, and Release
If you are injured, you agree to be responsible for medical and evacuation costs not covered by insurance. To the fullest extent permitted by applicable law, you release and hold harmless Naru Zanzibar LLC and its officers, members, agents, contractors, employees, volunteers, guides, hosts, drivers, captains, crew, suppliers, and other representatives from claims and Losses arising from ordinary and inherent travel risks and voluntary participation in the Experience.
This release does not apply to gross negligence, willful misconduct, or liability that cannot lawfully be waived.
Indemnity and Binding Effect
You must disclose dietary requirements, special meal requests, allergies, pregnancy, mobility needs, medical concerns, and other important requests at booking. Requests are subject to availability and cannot be guaranteed. You are responsible for checking and confirming requests before travel.
To the fullest extent permitted by law, you agree to indemnify and hold harmless the Company parties from liabilities, court costs, and reasonable legal fees arising from your breach of these Terms, unlawful conduct, failure to disclose material information, or negligent acts, excluding gross negligence or willful misconduct by a Company party.
It is intended that applicable releases, waivers, and obligations bind you and, where legally permitted, your spouse, family members, heirs, assigns, and personal representatives.
Validity of Prices and Information
Website and booking prices are based on costs in effect when published. Naru Zanzibar may change prices before full payment is received. Dates, itineraries, availability, and prices are indicative until confirmed. The price stated in the booking confirmation is the applicable price, subject to any permitted surcharge, amendment, additional service, occupancy change, or government fee.
Traveller Responsibility
Travel and activities may involve personal risk. By confirming a booking, you acknowledge that you have considered the risks, dangers, and challenges in light of your capabilities and needs and willingly assume the ordinary risks of participation.
You are responsible for researching local customs, weather, safety concerns, physical requirements, and applicable laws and are encouraged to consult your embassy or consulate before departure.
Severability
If a provision is invalid, void, or unenforceable, it will be severed or limited only to the minimum extent necessary, and the remaining provisions will continue in effect. A provision considered too broad will be interpreted as broadly as legally enforceable.
Images and Marketing
During an Experience, photographs, videos, audio, or other media may be created by other travellers, Naru Zanzibar, its representatives, guides, hosts, contractors, or service providers and may feature you in whole or in part.
By participating, you grant Naru Zanzibar LLC, its affiliates, agents, representatives, licensees, successors, and assigns a perpetual, worldwide, irrevocable, royalty-free right and license to use, reproduce, edit, display, exhibit, publish, distribute, transmit, and create derivative works from your image, likeness, and voice recorded in photography, video, audio, or other media for any lawful purpose, including marketing, promotion, advertising, social media, trade, and publication, without additional notice, approval, payment, compensation, or geographic or time limitation.
You waive the right to inspect or approve materials containing your likeness and waive royalties or other compensation relating to the permitted use.
Group Photos
Naru Zanzibar representatives may arrange group photographs or videos during an Experience. These materials may appear on Naru Zanzibar’s social media channels, websites, advertisements, and promotional materials.
If you prefer not to participate, kindly excuse yourself from group photographs and recordings organized by Naru Zanzibar representatives.
Other Conditions and Refusal of Service
Every guest must comply with the terms, requirements, laws, rules, and regulations of applicable service providers and governmental authorities and is responsible for a failure to comply.
Naru Zanzibar may refuse service or discontinue participation at any time for a lawful reason, including safety, conduct, non-payment, fraud, abuse, or violation of these Terms.
General
Entire Agreement
These Terms, together with the booking confirmation and incorporated documents, constitute the agreement between you and the Company concerning the booking and replace prior representations concerning the same subject matter.
Force Majeure
Where the Company is prevented or delayed from performing because of an act of God, strike, trade dispute, fire, inclement weather, breakdown, transportation interruption, government or political action, war, terrorism, third-party act or omission, or another cause outside its reasonable control, the Company will not be liable and may cancel the Experience or take another reasonable action by written notice.
Under those circumstances, you may be ineligible for a refund, and the Company will not be responsible for preparation costs, airfare, travel documents, or other Losses or claimed damages.
Choice of Law and Jurisdiction
These Terms and the booking agreement shall be governed by and construed in accordance with the laws of the State of New York and shall be subject to the exclusive jurisdiction of the courts located in New York.
Interpretation, Waiver, and Headings
These Terms, including releases and waivers, are intended to be as broad and inclusive as permitted by applicable law. Failure or delay in enforcing a provision is not a waiver. Headings are for convenience and do not define or limit a provision.
Disclaimer
By purchasing an Experience, you acknowledge that itinerary and service details may change and that travel and physical activities involve inherent risks.
An itinerary is a general guide and does not guarantee that every referenced place, activity, route, wildlife encounter, vessel, condition, or supplier will be available. Details are provided in good faith and may be modified based on weather, tide, safety, local factors, traveller feedback, supplier operations, or Company research.
Review the final itinerary shortly before travel. You acknowledge and assume responsibility for your decision to participate in activities and for the ordinary and inherent risks associated with them.
